Often times, legal matters can be settled out of court through mediation or arbitration. A neutral third party meets with everyone involved and attempts to help the parties reach a compromise on the issue at hand. However, not every legal issue can be resolved in this manner, and in many cases, litigation must be pursued.
Litigation may be necessary in a variety of cases, including divorce, child custody, foreclosure, criminal cases, and more. If you are facing the prospect of litigation, it is critical that you have someone who is not only comfortable in the courtroom, but can offer you razor sharp representation when you need it most.
The Litigation Process
1. The Plaintiff Sues
The plaintiff brings forward a case by notifying the court and the defendant of intent to sue.
2. The Defendant Answers
The defendant has a window of time in which to answer the notification, or to bring a countersuit against the plaintiff. At this time, other parties to the suit may be brought in as well.
During this stage of the litigation process, an investigation commences and the facts of the case are revealed.
The case goes to trial, and both parties present their case to a jury of their peers. A decision is made and the judge issues a court order.
In the event that one or more parties are not satisfied with the outcome of the trial, an appeal is the next step.
